What the Law Says
If you’ve been injured while travelling in a bus, taxi or rideshare vehicle, the driver owes you a high duty of care. This is because they are considered a “common carrier” — a provider who transports passengers for a fee — and must take all reasonable steps to ensure your safety.
In addition to this common law duty, a contractual duty often exists, especially when you have paid for the trip. If the driver fails in this duty and their negligence results in your injury, you may be entitled to substantial compensation.
This was confirmed in French v QBE Insurance (Australia) Limited & Others [2011] QSC 105, where a taxi driver was found liable for a passenger’s injuries sustained after exiting the vehicle. This case illustrates the strict legal expectations placed on transport providers.

Are there time limits in bringing a claim?
